1. scope of application

(1) These General Terms and Conditions (GTC) apply to all contracts that a consumer or entrepreneur concludes with Brickx UG (haftungsbeschränkt), Infanteriestraße 11a, Haus B2, 80797 Munich, Germany (Managing Director: Björn P. Wachner, Commercial Register: Munich Local Court HRB 262923, VAT ID: DE340303969) for the goods offered in the online store www.brickx.bio.

(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the legal transaction, is acting in the exercise of their commercial or independent professional activity (Section 14 BGB).

2 Conclusion of contract

(1) The presentation of goods in the online store does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking on the „Buy now“ button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

(3) Confirmation of receipt of the order is sent automatically by e-mail and does not constitute acceptance of the contract.

(4) The contract is concluded by express declaration of acceptance in text form or at the latest by delivery of the goods.

3. prices, shipping costs, payment methods

(1) All prices are quoted in euros and include the applicable statutory value added tax.

(2) Shipping costs are clearly communicated to the customer during the ordering process and are to be paid in addition to the price of the goods.

(3) The following payment methods are offered: PayPal, credit card, Klarna, prepayment/bank transfer (the available options are displayed in the order process).

4. delivery, availability of goods

(1) Delivery shall be made within the delivery times specified on the product page.

(2) Partial deliveries are permissible insofar as they are reasonable for the customer.

5. reservation of title

The goods remain the property of Brickx UG (haftungsbeschränkt) until payment has been made in full.

6. right of withdrawal for consumers

(1) Consumers have a statutory right of withdrawal of 14 days.

(2) The detailed revocation instructions including the sample revocation form are available on the website www.brickx.bio and will be sent to the customer by e-mail together with the order confirmation.

7. warranty

(1) The statutory warranty rights shall apply.

(2) For entrepreneurs, the limitation period for claims for defects is one year from delivery of the goods.

(3) The warranty period for new goods may not be shortened vis-à-vis consumers.

8. liability

(1) Brickx is liable without limitation for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty.

(2) Brickx shall only be liable for other damages in the event of intent or gross negligence.

(3) In the event of simple negligence, Brickx shall only be liable for the breach of essential contractual obligations (cardinal obligations). Liability is limited to the foreseeable damage typical for the contract.

(4) Liability under the Product Liability Act remains unaffected.

9. storage of the contract text

The contract text is stored by Brickx, but is not freely accessible for security reasons. The customer receives the order data and the GTC by e-mail.

10 Applicable law, place of jurisdiction

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers, this choice of law shall only apply insofar as it does not deprive them of the protection of mandatory provisions of the state in which they have their habitual residence.
(3) If the customer is an entrepreneur, the exclusive place of jurisdiction is the registered office of Brickx UG (haftungsbeschränkt).

11. online dispute resolution, consumer arbitration

The EU Commission provides a platform for out-of-court online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr
Brickx is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. severability clause

Should individual provisions of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
